Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access the Service.
If you wish to purchase any product or service made available through the Service, you may be asked to supply certain information relevant to your purchase including, without limitation, your name, email address and payment details.
Payments are processed through third-party payment processors:
We do not directly collect or store your payment card information. All payment processing is handled securely by these third-party providers in accordance with their respective terms of service and privacy policies. By making a purchase, you agree to the terms and policies of the applicable payment processor.
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis through your chosen platform (Apple App Store, Google Play Store, or Paddle).
You can cancel your Family Tools membership at any time, and you will continue to have access to the service through the end of your billing period.
Refunds are handled according to the policies of your payment platform (Apple, Google, or Paddle) and are not guaranteed. We reserve the right to issue refunds at our sole discretion on a case-by-case basis.

Account Owners are responsible for managing their family accounts, including monitoring content shared by family members and managing user permissions.
To improve the Service and user experience, we collect anonymized crash analytics and usage analytics in compliance with Apple App Store and Google Play Store requirements. This data is collected in a way that does not personally identify individual users and helps us:
Account Owners have the ability to opt out of analytics collection for their entire family or for individual family members at any time through the app settings. Opting out will not affect your ability to use any features of the Service.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, images, or other material ("User Content"). You retain all ownership rights to your User Content. By posting User Content to the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, display, and transmit your User Content solely for the purpose of providing and improving the Service.

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Zerin Technologies LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

You agree to defend, indemnify, and hold harmless Zerin Technologies LLC, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Zerin Technologies LLC endeavors to secure all personal information but has no control over, and assumes no responsibility for, the content, or practices of any third party. You further acknowledge and agree that Zerin Technologies LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by any third party in connection with the Service.
IN NO EVENT SHALL ZERIN TECHNOLOGIES LLC, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR TWENTY-FIVE DOLLARS ($25), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Before filing a claim, you agree to contact us at support@familytools.app and attempt to resolve the dispute informally. We'll attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or we may bring a formal proceeding.
If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Utah, or at another mutually agreeable location, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
YOU AND ZERIN TECHNOLOGIES LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
Either party may bring a lawsuit in court in the following circumstances:
You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice to support@familytools.app with the subject line "Arbitration Opt-Out" and including your name and account email address.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
No waiver by us of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Zerin Technologies LLC concerning the Service and supersede all prior agreements and understandings.
These Terms shall be governed and construed in accordance with the laws of the State of Utah and the United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Utah for the purpose of litigating all such claims or disputes (except those subject to arbitration).
